This policy details the procedure for when a case officers proposed decision differs from the recommendation made by the Planning & Licencing Committee of St Stephen in Brannel Parish Council and therefore activates the “Local Council Protocol” (also referred to as 5-day protocol).
It is based on the principles that the Committee may wish to revaluate its original decision given any new information and the proposed decision explanation received from the case officer, and that there is insufficient time to call an extra ordinary meeting for further discussion.
- The case officer contacts the Clerk and/or Deputy Clerk advising of the disagreement and the reasons of their proposed decision.
- The Clerk and/or Deputy Clerk forwards the email and texts the three (3) Councillors who have been appointed to the 5-day protocol panel with the Clerk under the Scheme of Delegation. The other members of the Planning & Licencing Committee are also sent the email.
- The Clerk and/or Deputy Clerk forwards the email, where possible, to the applicant or agent with a copy of this policy.
- Members of the panel will be responsible for ensuring that their vote is informed and based on proper planning guidance and application information.
- The Clerk and/or Deputy Clerk will advise the case officer of the result of the re-considerations.
- The Clerk and/or Deputy Clerk will advise the applicant or agent, where possible, of the result of the re-considerations and update the appropriate records, including the website.
- If there has been no change to the original resolution, the details of the application and the result of the re-consideration will be announced at the next Planning & Licencing Committee meeting and recorded in the minutes.
- If there has been a change to the original resolution, the details of the application and the result of the re-consideration will be taken to the next Planning & Licencing Committee meeting to be ratified and recorded in the minutes.
